Throughout the site, the terms “we” ,“us” and “our” refer to Nikaza Asian Couture. We offer this website (www.nikazaofficial.com), including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service” ,“Terms”).
These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. General Conditions and Account Responsibilities
Age Requirement: By agreeing to these Terms, you represent that you are at least
the age of majority in your state or province of residence, or that you are the age of
majority and have given us your consent to allow any of your minor dependents to
use this site. We reserve the right to only accept orders from individuals over 18
years of age.
Account Security: You agree to provide current, complete, and accurate purchase
and account information for all purchases made at our store. You must notify us of
any breach of security or unauthorized use of your account.
Right to Refuse Service: We reserve the right to refuse service to anyone for any
reason at any time.
Reproduction of Service: You agree not to reproduce, duplicate, copy, sell, resell,
or exploit any portion of the Service without express written permission by us.
3. Order Placement, Acceptance, and Cancellation By Us
Order Acknowledgment: You place an order on the site by adding your selected
item(s) to the shopping bag and proceeding to checkout. When you place your order
at the end of the online checkout process, we will acknowledge it by email.
No Binding Contract upon Email Acknowledgment: Please note that the order
confirmation email is merely an acknowledgment of your request and does not
constitute acceptance of your order or form a legally binding contract.
Our Right to Cancel: We reserve the right, at our sole discretion, to refuse, restrict,
or cancel any order for any reason at any time, including after an order
confirmation email has been sent or your payment has been processed. This
may occur due to product unavailability, inaccuracies or errors in product or pricing
information, inability to authorize payment, or suspected fraudulent activity.
Monies Reversal: If we cancel an order after your payment has been processed, the
full amount paid will be reversed back to your credit card or original bank account
within 5 to 7 working days. No cash refunds will be issued.
4. Cancellations By The User and Chargebacks
User Cancellation Window: If we receive a cancellation notice within 24 hours of
placing the order, we shall cancel the order and refund the entire amount to your
account within 5 to 7 working days. We cannot process a cash refund under any
circumstances.
Processed and Custom Orders: We cannot cancel orders that have already been
processed or orders for which a cancellation request is received after the 24-hourwindow. Furthermore, due to the custom-made nature of made-to-order products,
they are non-refundable and cannot be canceled once processed.
Chargebacks: If you raise a chargeback (whether warranted, unwarranted,
authorized, or otherwise), we are entitled to pause order processing, delivery, or
shipping until the issue is resolved and the chargeback is irrevocably withdrawn. If
the product has already been delivered, you undertake to return it in good condition
to our registered address.
5. Pricing, Modifications, and Billing
Price Changes: Prices for our products are subject to change without notice. We
reserve the right at any time to modify or discontinue the Service (or any part or
content thereof) without notice.
Pricing Errors: While we strive for accuracy, errors may occur. If a product is listed
at an incorrect price, we may, at our discretion, contact you for instructions or cancel
your order and notify you.
Price Match Policy: Our price match policy is applicable only prior to the initial
payment of an order. The price can only be compared with an identical product
available publicly through another sales channel within the same geographical
location. Final prices are determined at our sole discretion.
6. Nature of the Goods and Customization
Visual Accuracy: We have made every effort to display as accurately as possible
the colors and images of our products. We cannot guarantee that your computer
monitor's display of any color will be accurate.
Hand-Finished Items: Many of our garments are hand-finished or
hand-embroidered. These garments may exhibit small irregularities and vary from
examples shown on the website, which is not a manufacturing fault. Fabrics such as
chiffon and georgette are susceptible to pulls and rips and are not designed for
hard-wearing.
Made-to-Measure Garments: We produce made-to-measure garments and
alterations according to the specifications you provide. Sizes above XL will incur an
extra 10% to 15% charge. If you wish to change specifications after your order is
confirmed, you must contact us immediately; an additional fee may apply to
accommodate the change.
7. Delivery, Taxes, and Duties
Estimated Timelines: Delivery may take 6-8 working weeks. Estimated delivery
dates are provided as a guide only and depend on stock availability, customization,
and other external factors.
Receipt of Goods: We require that all deliveries are signed for by a person at the
delivery address. The signature is conclusive evidence that the goods have been
delivered.
Taxes and Duties: VAT, duties, and taxes will be applicable as per your country’s
regulations and are to be borne by the customer. The price of the goods does not
include sales taxes, import duties, or other levies. You are solely responsible for
bearing any customs duty necessary to release your goods from customs.
8. Third-Party Links and Optional Tools
Third-Party Providers: We may provide you with access to third-party tools over
which we neither monitor nor have any control or input. We provide access to such
tools ”as is” and “as available” without any warranties.
External Links: Third-party links on this site may direct you to third-party websites
that are not affiliated with us. We are not liable for any harm or damages related to
the purchase or use of goods, services, resources, or content made in connection
with any third-party websites.
9. Prohibited Uses
In addition to other prohibitions set forth in these Terms, you are prohibited from using the

For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.

Liability Cap: In no case shall Nikaza Asian Couture, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind (including lost profits, lost revenue, or loss of data) arising from your use
of the Service or any products procured using the Service. Our total liability to you in
connection with your purchase will be strictly limited to the amount you paid us for the
goods and delivery.
11. Indemnification and Force Majeure
Indemnification: You agree to indemnify, defend, and hold harmless Nikaza Asian
Couture and our parent, subsidiaries, affiliates, partners, officers, directors, agents,
contractors, and employees from any claim or demand, including reasonable
attorneys’ fees, made by any third party due to or arising out of your breach of these
Terms of Service or your violation of any law or the rights of a third party.
Force Majeure: We will not be liable or responsible for any failure to perform, or
delay in performance of, any of our obligations that is caused by events outside our
reasonable control. This includes strikes, lock-outs, civil commotion, riot, terrorist
attack, war, fire, explosion, storm, flood, epidemic, pandemic, or impossibility of the
use of public or private transport or telecommunications networks.
12. Severability, Waiver, and Entire Agreement
Severability: If any provision of these Terms is determined to be unlawful, void, or
unenforceable, such provision shall nonetheless be enforceable to the fullest extent
permitted by applicable law, and the unenforceable portion shall be deemed severed
from these Terms. This shall not affect the validity of any other remaining provisions.
Waiver: No relaxation or delay by us in exercising any right or remedy shall operate
as a waiver of that right. The failure of us to exercise or enforce any right or provision
shall not constitute a waiver.
Entire Agreement: These Terms of Service and any policies or operating rules
posted by us constitute the entire agreement and understanding between you and
us, superseding any prior agreements, communications, and proposals (including
prior versions of the Terms of Service).
13. Governing Law and Changes to Terms

laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction
of the courts of England and Wales.
